Terms of Use
1. General
1.1 Sicknote (ABN 72 096 229 784), hereby referred to as We, Our or Us, provides the Sicknote online platform for requesting online medical certificates from Australian registered healthcare providers. The Platform enables Users to submit a request for a medical certificate 24 hours a day, with practitioners reviewing all request between the practitioner operating hours.
1.2 In these Terms, a reference to You or Your is a reference to a Patient User (being the Patient and/or an Authorised Person, if applicable) of the Platform.
1.3 By accessing and using the Platform, You agree to be bound by these Terms, which may be amended from time to time.
1.4 We may amend these Terms at any time by publishing the amended version on the sicknote.me website. Any such amended version will apply to Your use of the Platform from the date of its publication.
2. Medical Certificates
2.1 All requests are clinically reviewed by an Australian Registered Health Practitioner. The practitioners reserve the right to reject any request. Should your request be rejected, you will be issued a refund (less the transaction fee) within 5-10 business days.
2.2Medical certificates will not be backdated. Certificates will be dated the day of the review.
2.3 Extension are not available on Our medical certificates. Patient Users will be required to make a new request and undergo a new review prior to the issue of a new certificate.
2.4 Our service does not include appointments, treatments, therapies or prescriptions. If the patient requires medical attention, they must seek appropriate care from a medical centre or hospital.
2.5 Our service is not suitable for Workcover, Australian Courts or Centerlink (Services Australia), due to formal documentation required. Use of our Standard medical certificate may result in a rejection from these bodies.
3. Access and Use
3.1 While accessing or using the Platform, You must not:
(a) breach any laws, or encourage the undertaking of any illegal act, including participating in conduct that is unlawful, defamatory, obscene, threatening, abusive or hateful;
(b) infringe any person’s rights, including rights of confidentiality, or intellectual property and proprietary rights;
(c) impersonate any other person;
(d) include any malicious material that contains any virus or harmful code, or program that is designed to impair the performance of the Platform or any device accessing the Platform;
(e) publish or link to malicious content.
3.2 While we take all reasonable steps to limit any service interruptions that may impact Your access to the Platform, You acknowledge and agree that:
(a) issues out of Our control may prevent Your access to the Platform;
(b) we cannot promise continuous or error-free access to the Platform, including to third party services utilised by the Platform such as online payments; and
(c) the functionality and experience of the Platform may change from time to time.
4.Data and Third-Parties
4.1 We take user privacy and data security very seriously. To meet strict Payment Card Industry Data Security Standards we employ the third-party services of Stripe, to encrypt and protect your financial information. We also adhere to the Australian Privacy Act and Privacy Principles in when handling Your personal and sensitive information. 4.2 You acknowledge and agree that:
(a) the Platform provides links to and utilises third-party systems and content;
(b) we are not responsible or liable for any information contained on any linked third-party website, including legal, medical or financial information; and
(c) we are not responsible for the maintenance and performance of third-part apps utilised by Users on the Platform.
You also agree that:
(a) You will not do anything to compromise the security or privacy of Our systems or of the information on Our systems;
(b) while we will make every reasonable effort to ensure the safe and secure transmission of data You accept that the internet is not a fully secure environment and that We cannot accept responsibility for misuse, loss of, or unauthorised access to or disclosure of, information where the security of the information is not within our control; and
(c) if You provide Us with information via the internet, You do so accepting this risk.
4.3 We perform backups of the Platform in a responsible manner at times that are reasonable for Our business purposes. However, We do not warrant that We are able to backup or recover specific Patient User content from any period of time.
4.4 If, You provide Personal or Sensitive Information about someone other than Yourself to the Platform, You warrant that You have that person’s consent to You providing such information to Us for the purpose specified.
5. Liability and Indemnity
5.1 You acknowledge and agree that:
(a) Our service is not a substitute for face-to-face or telehealth medical care;
(b) we do not provide medical advice, treatments or therapies, and must not be relied upon in relation to any critical, emergency or acute care medical circumstances;
(c) we make no representation or warranty that an appointment, treatment, therapy or prescription will be provided;
5.2 To the extent permitted by law, You acknowledge and agree that:
(a) You use the Platform at Your own risk;
(b) You are solely responsible for the accuracy and suitability of any information or data that You provide to the Platform;
(c) you agree to indemnify Us for any loss, damage or claim (including the loss or corruption of data) that We may suffer as a result of any breach by You of these Terms.
